Police in the District of Columbia recommended arresting David Gregory, then a correspondent for “Meet the Press,” over a 2012 broadcast in which he waved a 30-round gun clip at the head of the National Rifle Association, according to an affidavit made public this week.

Gregory was debating banning high-capacity magazines with NRA leader Wayne LaPierre during a segment at the D.C. -based studio. The district bans such weaponry, whether loaded or not.

Though Gregory was not arrested or exciting for the violation, police at the time recommended that he should be, according to document obtained by a blog and a conservative regime transparency group.

Washington Metropolitan Police Department Det. Wayne Gerrish requested a warrant and said the network was attentive that possessing such a magazine was illegal, said U.S. News & World Report.

NBC staff had emailed police asking if it would be legal to show the stick clip, according to the affidavit. Two responses said it would violate local law, according to the document.

In 2013, a district prosecutor declined to charge Gregory.

Blog Legal Insurrection filed a Freedom of Information Act request for the detective’s statement. Conservative watchdog group Judicial Watch, filed a lawsuit on the blog’s behalf.
